Terms of service.

These terms are an agreement between you and AVIDZ Business Private Limited for using HOTKOK at hotkok.com. Part A applies to everyone, Part B to labels and artists who fund campaigns, Part C to creators and Part D to partners (aggregators and distributors). Please read them with our privacy notice and refund policy.

Part A — Everyone

HOTKOK is operated by AVIDZ Business Private Limited (CIN U92490DL2022PTC408368), registered office: D-1/LG-9, LG/F, Dilshad Colony, East Delhi, Delhi 110095, India. In these pages, “HOTKOK”, “we” and “us” mean AVIDZ Business Private Limited.

  • Accounts. You sign in with your mobile number. Keep your phone and codes to yourself; you’re responsible for activity on your account. One person or business per account, and the details you give must be true and current.
  • What HOTKOK does. We connect people who fund song promotion with independent creators, verify reels, track results and handle payments. We are not a party to the creative work itself, and we don’t employ creators.
  • Acceptable use. Don’t break the law, infringe anyone’s rights, use bots or bought engagement, scrape or reverse-engineer the service, interfere with its security, or use HOTKOK to contact users for deals outside it in a way that deceives them.
  • Instagram. Your use of Instagram stays subject to Meta’s terms and community guidelines. HOTKOK is not affiliated with or endorsed by Meta.
  • Suspension. We may pause or close accounts that break these terms, commit fraud or put others at risk. Where we can, we’ll tell you why and let you respond. Money already owed for valid work is handled as described in Parts B and C.
  • Our brand and service. The HOTKOK name, logos, software and content belong to us. You get a personal, non-transferable right to use the service under these terms.
  • No guarantees. The service is provided “as is”. We work hard to keep it accurate and available, but platform data comes from third parties (including Instagram) and may be delayed, change or be unavailable.
  • Liability. To the extent the law allows, we aren’t liable for indirect or consequential losses, lost profits or lost data, and our total liability to you for any claim is limited to the fees you paid us (for customers) or the amounts due to you (for creators) in the 12 months before the claim. Nothing here limits liability that can’t be limited by law.
  • Indemnity. You’ll compensate us for losses caused by your breach of these terms or your infringement of someone else’s rights.
  • Invites. Creators, labels and approved partners have an invite code. When someone you invite works on HOTKOK, you earn a share of what HOTKOK earns from them, for a limited time and up to a monthly limit, as shown on your “Invite and earn” page. You earn only from people you invite yourself, not from the people they invite. Each person or business can be invited once, when their account is created; your own accounts, and accounts of the same person or business, don’t count. Rewards come only after the money is final, and we may cancel an invite or take back a reward that hasn’t been paid if it was misused. We may change the rewards or stop the program for new invites; rewards already earned are paid.
  • Changes. We’ll post changes here with a new effective date and tell you in the app before significant changes apply. Continuing to use HOTKOK after that means you accept them.
  • Law and disputes. These terms are governed by the laws of India. Please contact us first (support@hotkok.com); if we can’t resolve it, the courts at Delhi have exclusive jurisdiction.

Part B — Labels and artists

  • Rights. When you create a campaign you confirm that you own or control the rights needed to promote the song, that the Instagram audio you link is that song, and, if you act for someone else (for example, a label acting for an artist), that you’re authorised to. You are responsible for any claim that the campaign infringes someone’s rights.
  • Content we don’t accept. Songs that are unlawful, hateful, sexually explicit, defamatory or that promote violence. Songs marked mature are offered only to suitable creators.
  • Prepaid budget and fee. You pay the campaign budget and our platform fee upfront. The budget is held for the campaign and spent only on verified reels; the fee pays for the service. Prices, estimates and fees are shown before you pay; estimates of reach are estimates, not promises.
  • Results. Creators are independent and choose whether to take an offer. A campaign can be open to everyone, only creators’ own accounts or only pages, as you choose; the account type is what the creator declares, and we may correct it. We verify that each reel uses your song’s Instagram audio, belongs to the creator and meets the campaign requirements, and we pay creators on verified performance. We do not guarantee views, streams, chart positions or any particular result. Song reports show what happened during the campaign; other promotion and many other factors can affect a song.
  • Creator prices. To keep the market fair, individual creators’ prices are private. You see cost bands and campaign totals.
  • Ending a campaign and refunds. You can end a campaign at any time. Reels already accepted are still tracked and paid; unused budget is refunded as described in the refund policy. The platform fee is not refundable once the campaign is live.
  • Use of reels. You may share links to the reels made for your campaign and the results in your own reports and promotion, crediting the creator. You may not download, re-upload or edit creators’ reels without their permission.
  • Invite credit. What you earn from invites is credit that pays part of the platform fee on your next payments. Credit isn’t cash, can’t be withdrawn or transferred, and never pays the creator budget.
  • Invoices and taxes. We issue tax invoices for amounts you pay us. You’re responsible for the taxes that apply to you.

Part C — Creators

  • Who can join. You must be 18 or older, living in India, with an Instagram Creator account you control and at least the minimum followers we show when you sign up. Joining may need an invite code. We may check your account’s engagement and decline or review accounts that don’t meet our standards.
  • Your accounts. You can connect more than one Instagram account, up to the number shown in the app: your own and pages you run. Connect only accounts you own or run yourself, and tell us truthfully whether each is your own account or a page. Each account gets its own offers and price; one PAN and one payout cover all of them, and you are responsible for everything posted from each. We may correct an account’s type or remove an account that isn’t yours to connect.
  • Your price. You tell us your price per reel for each account. Our team checks every price before that account gets offers, and may call you to agree a different price. You can lower your price at any time; a higher price is checked again. Offers you already have keep their price.
  • Offers. We show you paid offers for songs that suit your audience. An offer shows your price for the reel before you accept. You choose how many campaign reels each account can post a day, and you can accept up to that many offers a day for it. After you accept, you have 72 hours to post and submit the reel, or the offer lapses. If offers you accepted keep lapsing, our team may contact you and lower the number of offers that account can take a day.
  • Reel requirements. Each reel must:
    • use the song’s Instagram library audio from the campaign link (not audio added in another app, which shows as original audio);
    • be posted on your connected account after you accepted the offer, and meet the campaign’s requirements (such as using at least 15 seconds of the song);
    • be labelled as paid promotion as required by the ASCI guidelines, for example with Instagram’s paid-partnership label or #ad;
    • be your own original content, follow the campaign’s policy on AI-generated content, and never impersonate or deepfake a real person; and
    • stay live and public for at least 30 days.
  • Pay. You earn the price shown on the offer, plus any views bonus the offer describes, once the reel passes our checks and its 7-day tracking. Payment is released after a holding period used to catch fraud, then paid weekly to your verified UPI ID or bank account when your balance reaches the minimum shown in the app. You need a verified PAN to be paid. We deduct TDS as the law requires and give you the details.
  • WhatsApp messages. We send you WhatsApp messages about work you’ve taken on and your money — posting deadlines, reel results, your Instagram connection and payouts. Messages about new offers are sent only if you turn them on. You can turn either kind off any time in Profile. We don’t message at night.
  • Unclaimed earnings. If money you earned is waiting because you haven’t added a verified PAN and UPI ID or bank account, we remind you in the app (and by WhatsApp where we can), and send a final notice before the deadline. If the details still aren’t added within 12 months after the payment became due, that amount goes back to the campaign that funded it and is no longer owed to you.
  • Fake engagement. Bought views, likes, comments or followers, engagement pods, bots or misleading edits aren’t allowed. If we find them, the reel isn’t paid, amounts not yet paid are cancelled, amounts already paid for that reel can be recovered, and you may be banned from HOTKOK.
  • Deleted reels. If you delete or hide a reel before the 30 days end, it isn’t paid; if it was already paid, we may recover the amount.
  • Your content. You keep ownership of your reels. You allow us and the campaign’s label to show links to them, their thumbnails and their performance in the app and in song reports.
  • Independent work. You work for yourself, not as our employee or the label’s. You’re responsible for your own taxes beyond the TDS we deduct.
  • Invite and earn. What you earn from invites is paid with your weekly payout, with tax (TDS) deducted, once your payout details are verified.

Part D — Partners (aggregators and distributors)

  • Applying. Aggregators and distributors can’t sign up or be invited; you apply, and our team may call you and approves or declines the application. We may put a partner account on hold or close it, for example for misuse.
  • What partners do. Partners invite labels and creators with their invite code. Partners don’t run campaigns; labels run their own. A partner can’t earn from other partners.
  • Commission. Your commission is a share of what HOTKOK earns from the labels and creators you invite, as shown on your page. We pay it to the bank account or UPI ID you give us, with tax (TDS) deducted, and send you the payment reference. If you’re registered for GST, you’ll send us an invoice for it.
  • Honest invites. Don’t promise labels or creators results, prices or payments on our behalf, and don’t invite yourself or businesses you control.
